5-hour ENERGY® Counterfeit Product Reports

Farmington Hills, MI - November 19, 2012

We recently discovered counterfeit 5-hour ENERGY® products circulating in the marketplace. We acted swiftly to identify and halt the counterfeiting operation. We filed suits in U.S. Federal District courts in both California and New York. As a result, we were able to find the counterfeiters' factory and shut it down. We have also executed court orders that have permitted us to seize large quantities of fake product from numerous locations as well the machinery used by the counterfeiters to package the counterfeits.

We are working hard to communicate with our loyal consumers and distribution network about the matter and although we do not and cannot guarantee the counterfeit products are safe because we did not manufacture them, we are unaware of any serious adverse events relating to the counterfeits.

We have asked the authorities, including law enforcement, to investigate and bring to justice anyone involved in knowingly producing, distributing and selling counterfeit 5-Hour ENERGY®.

Since it remains an active investigation and litigation, we are unable to share any further details.

Consumers, distributors and retailers can identify counterfeit 5-hour ENERGY® product by looking at the lot numbers on the bottom of the bottle.  We have identified counterfeits of our product in three flavors, regular strength Berry, Extra Strength Berry and regular strength Orange. The following are the lot numbers:

• Regular Strength Berry

  - lot number W20712K6
• Extra Strength Berry
  - lot number 115811P3
  - lot number W08912J4
  - lot number 119812P4
• Regular Strength Orange
  - lot number 115111A2
  - lot number 105112R2
  - lot number 120012T2

Please note that the counterfeiters used lot numbers that also appear on authentic 5-Hour ENERGY®, so both fake and some real bottles have these lot numbers.

We have set up a 1-800 number for consumers to call if they currently have a counterfeit product.  The Consumer number is 1-866-324-7949. 

We also set up a number for retailers and distributors to call if they currently have counterfeit products.  The Retailer number is 1-877-324-7987.

After speaking with us, those with counterfeit product will be asked to please mail it to:
