5-hour ENERGY® SCAVENGER HUNT CONTEST
OFFICIAL CONTEST RULES

VOID WHERE PROHIBITED OR RESTRICTED BY LAW.  ALL UNITED STATES FEDERAL, STATE, AND LOCAL LAWS APPLY. NO PURCHASE NECESSARY TO ENTER OR WIN.

1. General Description:

1. The 5-hour ENERGY® Racing Scavenger Hunt Contest (the “Contest”) is being conducted by Living Essentials, LLC (“Living Essentials”).
2. Participants must scour the 5-hour ENERGY® website and social channels for codes (and the Michael Waltrip Racing website for bonus letters) and submit their findings to Living Essentials.
3. Entry and registration in the Contest must be completed via the 5-hour ENERGY® website (http://www.5hourenergy.com/racing/contest_ScavengerHunt15_Form.asp) or the 5-hour ENERGY® Facebook Page (https://www.facebook.com/5HourEnergyShot?sk=app_205521576149308).  Upon registration, all participants unconditionally agree to, and accept, these Official Rules.  Registration will open via the 5-hour ENERGY® website on Monday February 11, 2013 at 11:00 AM EST and must be completed by 5:00 PM EST on Monday November 18, 2013 (the “Registration Deadline”). The Facebook Page registration option will be available on February 11, 2013 at 11:00 AM EST and must be completed by 5:00 PM EST on Monday November 18, 2013 (the “Registration Deadline”).

2. Eligibility:

1. The Contest is open to all U.S. residents, age eighteen (18) and over except where prohibited or restricted by law.
2. Employees, contractors, directors and officers of Living Essentials, and their respectiveparent, subsidiaries, or affiliated companies, distributors, advertising and promotion agencies, judging and other agencies (if any) involved in the administration, fulfillment and execution of this Contest and the immediate family members, and/or those living in the same household of each such employee, contractor, director and/or officer are not eligible to enter or compete in the Contest.

3. Registration:

1. Registrations must be submitted via the internet at http://www.5hourenergy.com/racing/contest_ScavengerHunt15_Form.asp or via the Facebook Page. The Facebook page registration option will be available on February 11, 2013 at 11:00 AM EST. All registrations must be received by the Registration Deadline.
2. By submitting a registration, each participant agrees to release, discharge, defend and hold harmless Living Essentials, Facebook, Michael Waltrip Racing Holdings, LLC, their parents, subsidiaries, affiliated companies, licensees, and assigns, and its respective officers, directors, employees, agents, and representatives from any claim or liability arising from or related to submitting a registration.
3. The first fifty (50) Contest entrants (the “First Entrants”) will each receive a free two pack (2 bottles) of 5-hour ENERGY® (approximate retail value of $5.98, based on an MSRP of $2.99 per bottle).  The free two pack will be delivered to the First Entrants as soon as practicable once the number of entrants reaches 50.

4. Selection of Winner:

1. The Winner will be drawn randomly from all entries received as of the Registration Deadline. A participant is not a winner of any prize unless and until the participant’s eligibility is verified and confirmed under these Official Contest Rules.  Living Essentials reserves the right to require a participant to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring Living Essentials adverse publicity.  Living Essentials reserves the right, in its sole and absolute discretion, to disqualify any Winner from any prize element, based on the background check and Living Essentials may select an alternative Winner.
2. Living Essentials will contact the Winner via email on or about November 25, 2013.  If the Winner does not respond to Living Essentials’ email within five business days, a new Winner will be selected at random and notified in the same fashion.  This process will continue until Living Essentials receives a response to its winning notification email.  The selection of the Winner will be final and binding.

5. Prize

The Prize will be awarded as follows:
The Winner will receive a one year supply of 5-hour ENERGY® (365 bottles), a T-shirt signed by Clint Bowyer and a 2012 Lionel 1:24 Die Cast Car (#15). The approximate cash value (“ACV”) of the prize outlined herein is $1,388.85 (based on a manufacturer’s suggested retail of $2.99 per bottle for regular strength, and $3.49 per bottle for Extra Strength); however the actual value may vary.  Any difference between the ACV and the actual value shall not be awarded.  The Winner must meet all eligibility requirements as set forth herein. Depending on the quality of entries, Sponsor may select additional winners.  The prize stated herein will be awarded assuming sufficient entries.

The Prize is not transferable, cannot be redeemed for cash and must be accepted as awarded.  In the event the Prize cannot be awarded as stated, Sponsor may substitute a Prize of equal or greater value in its sole discretion.

6. Publicity

By registering in the Contest, each participant agrees to willingly participate in potential publicity engagements, media exposure, interviews, video and/or audio recordings, and all other events relevant to the promotion and publicity of the Contest. In the event any participant is selected to participate in such events, the participant will be notified via phone and/or e-mail to confirm availability for such events. Participation in such events will have no bearing on the selection of the Winner.

7. General Terms and Conditions

1. Living Essentials shall not be responsible for any failed registrations or entries for any reason including without limitation those that are lost, late, damaged, delayed, incomplete, illegible, mutilated, misdirected, or on postage-due mail. Further, Living Essentials shall not be responsible for any electronic, network, and server failures or malfunctions or other technical errors of any kind.
2. Living Essentials reserves the right to cancel the Contest for any reason that it deems appropriate, including, without limitation, a computer virus, bug or other technical problem(s) that corrupts the administration or security or proper functioning of the Contest.  Should the Contest be cancelled prior to the Registration Deadline, notice will be e-mailed to all participants.

4. Living Essentials reserves the right to amend these rules and policies. Any changes willbe posted online at www.5hourenergy.com/racing.
5. Winners of any prize are solely responsible for all applicable federal, state, and local taxes.
6. All participants agree that Living Essentials and its respective affiliates, subsidiaries, employees, agents or other representatives of any kind shall not be responsible or liable for damages or losses of any kind arising out of or resulting from entry in this Contest, acceptance or use of a prize or any other matter related to the Contest, including, without limitation, claims based on property damage, personal injury and/or death, publicity rights, defamation or invasion of privacy.  
7. 5-hour ENERGY® is a registered trademark.
8. By registering for the Contest, participants agree and acknowledge that Living Essentials may use their respective names, images, and likenesses in connection with the Contest, for advertising purposes, on its website, social media channels, or in future similar campaigns or contests. 
9. Living Essentials reserves the right, at its sole discretion, to disqualify any participant found tampering with the Contest or violating these Official Contest Rules. Any attempt by a participant to deliberately damage the Scavenger Hunt Contest or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Living Essentials reserves the right to seek damages arising from such acts to the fullest extent of the law. If it is determined that the Contest is compromised in any way, then, at its sole discretion, Living Essentials can cancel the Contest. If any notification is returned as undeliverable, or if any participant violates these rules, the participant will be disqualified.
10. By entering the Contest, each participant, agrees to abide by and be bound by all decisions of Living Essentials relating to the Contest, which shall be final and binding in all respects, including but not limited to the determination of the Winner.  
11. If any portion of these Official Contest Rules is found to be invalid, illegal, or unenforceable, for any reason, that portion shall be severed from the rest.
12. The provisions of these Contest rules shall be construed and enforceable in accordance with the laws of the State of Michigan. By participating in the Contest, all participants agree that the venue for any dispute or litigation arising from or relating to this Contest shall only be in Farmington Hills, Michigan.
